This paper analyses the arguments for and against what we have called automatic organ procurement model in relation to the organs of the deceased. For this purpose, this work provides empirical evidence to assess the potential impact of this model on donation rates and on public opinion. Specifically, we examine first the reasons supporting this model, with special reference to utilitarian and justice arguments. On the other hand, we analyse both the approaches based on the violation of pre mortem and (...) post mortem interests opposing this theoretical model and the rejection the model would generate in the population. Finally, we point out the aspects that, in our opinion, should be exhaustively regulated if this model were implemented. In particular, we refer to the legal status of the human body, the treatments for end-of-life patients, the incentives for health professionals and the recognition of the right to conscientious objection. En "Paraconsistencia y fundamentación de las matemáticas" se reformula un aspecto del programa formalista de Hilbert, problema clásico dentro del panorama de la filosofía de las matemáticas. Lo anterior se hace desde un enfoque no clásico de la lógica, particularmente desde LP de Priest. Finalizando el articulo se rescatan las virtudes de la reformulación de este problema clásico y se evalúa hasta qué punto puede ser posible hablar del programa formalista desde la luz de la aritmética inconsistente de Priest.

El paper realiza una exposición sobre el concepto y contenido de la nulidad y el restablecimiento del derecho como medio de control a la luz de la Ley 1437 de 2011; enfocándola en asuntos ambientales a través del estudio de la licencia ambiental.

This research was carried out in order to verify by simulation Mendel’s laws and seek for the clarification, from the author’s point of view, the Mendel-Fisher controversy. It was demonstrated from: the experimental procedure and the first two steps of the Hardy-Weinberg law, that the null hypothesis in such experiments is absolutely and undeniably true. Consequently, repeating hybridizing experiments as those showed by Mendel, it makes sense to expect a highly coincidence between the observed and the expected cell frequencies. By (...) simulation, 30 random samples were generated with size equal to the number of observations reported by Mendel for his single trait trial, in this case, seed shape; assuming complete dominance, with genes A and a; likewise, it was simulated the results for the experiment with two traits, segregating in separate chromosomes, in this case seed shape, as before, and albumen color, with genes B and b, both loci with complete dominance. In the case of a single trait, the data only showed evidence for rejecting the null hypothesis (Ho ) in 1/30 samples, with (P<0.05). In the case of the 30 samples of the two traits experiment, (Ho ) was rejected only on 3/30 times, when it was set a = 0.05. In both simulations there was a high correspondence between the observed and expected cell frequencies, which is simply due to the fact that (Ho ) is true, and under these conditions, that is what would to expect. It was concluded, that Mendel had no reason to manipulate his data in order to make them to coincide with his beliefs. Therefore, in experiment with a single trait, and in experiments with two traits assuming complete dominance, segregation ratios are 3:1; and 9:3:3:1, respectively. Consequently, Mendel’s laws, under the conditions as were described are absolutely valid and universal. (shrink)

This paper critically examines the philosophical underpinnings of current experimental investigation into animal affect-related decision-making. Animals’ affective states are standardly operationalised by linking positively valenced states with “approach” behaviours and negatively valenced states with “avoidance” behaviours. While this operationalisation has provided a helpful starting point to investigate the ecological role of animals’ internal states, there is extensive evidence that valenced and motivational states do not always neatly align, namely, instances where “liking” does not entail “wanting” (and vice versa). To address (...) this limitation, this paper proposes the (re-)integration of dominance as a dimension of affect. In particular, I argue that dominance, construed as a measure of organisms’ self-assessed behavioural control, can provide the necessary nuance to understand animal affect-related decision-making. Thus, after addressing the theoretical and methodological challenges related to incorporating dominance into a definition of “core affect”, this paper introduces the “Valence-Arousal-Dominance” model of animal affect. This model is explored for its potential applications in two domains. Firstly, in the study of animal affect-related decision-making under predation risk, and secondly, in the study of animal wellbeing. Through these applications, this model aims to bring experimental paradigms of animal affect-related behaviour closer to ecologically relevant scenarios. (shrink)

Are some organisms more sentient than others? Recent attention within animal welfare research centres around which and how much evidence is sufficient to ascertain whether a species' members are sentient. However, as more species are recognised as potentially sentient, a pressing issue arises in policymaking: should all sentient species be regarded as sentient to the same extent? While a degreed notion of sentience has been criticised as conceptually implausible or ethically problematic, this paper argues that these objections are flawed. By (...) employing formal semantic tools, this paper proposes a delineation of the multidimensional structure of sentience that can serve as the basis for a framework for responsibly comparing degrees of sentience across species. The framework proposed underscores that the current debate regarding cross-species comparisons will only progress through an overall understanding of the different commitments that achieving welfare comparisons involves within the science-policy interface. Slurs’ meaning is highly unstable. A slurring utterance like ‘Hey, F, where have you been?’ (where F is a slur) may receive a wide array of interpretations depending on various contextual factors such as the speaker’s social identity, their relationship to the target group, tone of voice, and more. Standard semantic, pragmatic, and non-content theories of slurs have proposed different mechanisms to account for some or all types of variability observed, but without providing a unified framework that allows us to (...) understand how different contextual factors simultaneously influence slurs’ interpretation. To address this issue, I argue that slurs convey dimensional qualities such as, e.g., ‘negative valence, neutral arousal, high dominance’ instead of discrete emotional categories such as ‘contempt’. Then, I translate this hypothesis into a game-theoretic model of slurs’ interpretation inspired by Heather Burnett’s pioneering work on identity construction. This new model, called ‘Affective Meaning Games’ (AMG), captures the variability of slurs and integrates pragmatic reasoning within an independently motivated psychological understanding of emotional states. This paper explores nicknaming practices, focusing on their capacity to derogate and establish power differentials within a group. By examining ethnographic and psychological data, this paper contends that pejorative nicknames can contribute to unjust intra-group hierarchies and thus operate analogously to slurs within small social circles. Like expressions targeting social groups based on gender or ethnicity, pejorative nicknames can indeed elicit deep offence regardless of the speaker’s intentions or whether they occur within speech reports. Moreover, this paper advances a framework (...) suggesting i) that both forms of verbal aggression index multiple dimensional qualities such as “negative valence”, “neutral arousal,” and “high dominance” rather than discrete emotional categories such as “contempt” or “anger”, and ii) that the expression of high dominance in social interactions underlies their capacity to offend. Additionally, it translates this hypothesis into a Bayesian model of sociolinguistic variation inspired by Heather Burnett’s work on identity construction, thus integrating pragmatic reasoning into a psychologically informed framework for interpreting emotional cues. This paper argues that all-purpose pejoratives such as ‘jerk’ or ‘bastard’ are just plain vanilla descriptions of personality traits that are generally seen as impairing for the self and for interpersonal relationships across different contexts. Thus, all-purpose pejoratives derogate their referents through generalized conversational implicatures: it is common knowledge that those who use these terms accept certain kind of (negative) evaluations and that uses of those terms express such evaluations. One of the main advantages of this approach is that it (...) can be extended to more ‘thick’ pejoratives such as ‘wimp’ or ‘chicken’, which, as Kaplan (1998) himself suggested, are ‘purely descriptive’ of personality traits that are generally seen as ‘personal failings’. Before defending this theory, I criticize i) the standard assumption that allpurpose pejoratives are expressive and ii) the alternative semantic view that allpurpose pejoratives are conventionally associated with a judge parameter. In most domains of human life, we are willing to accept that there are experts with greater knowledge and competencies that distinguish them from non-experts or laypeople. Despite this fact, the very recognition of expertise curiously becomes more controversial in the case of “moral experts”. Do moral experts exist? And, if they indeed do, are there ethical reasons for us to follow their advice? Likewise, can emerging technological developments broaden our very concept of moral expertise? In this article, we begin (...) by arguing that the objections that have tried to deny the existence (and convenience) of moral expertise are unsatisfactory. After that, we show that people have ethical reasons to ask for a piece of moral advice in daily life situations. Then, we argue that some Artificial Intelligence (AI) systems can play an increasing role in human morality by becoming moral experts. Some AI-based moral assistants can qualify as artificial moral experts and we would have good ethical reasons to use them. (shrink)

El daño ambiental ha despertado el interés de la doctrina en Colombia, aunque aún no se aborda con rigor y profundidad. La razón, entre otras, es la omisión de los avances que ha dado el derecho comparado, donde la concepción del rol de las instituciones jurídicas va hasta una comprensión integral del daño a partir de la alteración funcional de los sistemas. Existe hoy cierto consenso respecto al deber ser del régimen de responsabilidad aplicable a esta noción integral del daño (...) ambiental, capaz de hacer frente a los componentes del medio natural y a todos los que lo conforman. El libro busca aportar al estudio del daño ambiental desde los avances antes descritos en la materia. (shrink)

Gorgias’ On Not-Being survives only in two divergent summaries. Diels–Kranz's classic edition prints the better-preserved version that appears in Sextus’ Aduersus Mathematicos. Yet, in recent years there has been rising interest in a second summary that survives as part of the anonymous De Melisso, Xenophane, Gorgia. The text of MXG is more difficult; it contains substantial lacunae that often make it much harder to make grammatical let alone philosophical sense of. As Alexander Mourelatos reports, one manuscript has a scribal note (...) that reads: "The original contains many errors; no one should blame me; I just copy what I see.". The treatise's state of preservation has aptly prompted Michael Gagarin to liken it to a black hole: "something we cannot see directly but know must exist because of certain effects it has on other objects.". Swear words are highly colloquial expressions that have the capacity to signal the speaker's affective states, i.e., to display the speaker's feelings with respect to a certain stimulus. For this reason, swear words are often called 'expressives'. Which linguistic mechanisms allow swear words display affective states, and, more importantly, how can such 'affective content' be characterized in a theory of meaning? Even though research on expressive meaning has produced models that integrate the affective aspects of swear words in a compositional (...) framework, there is extensive evidence that swear words cannot be assigned a single or stable affective interpretation across contexts. For example, even though expletive adjectives (e.g., 'damn'), particularistic insults (e.g., 'bastard') and slurs (e.g., 'wop') typically express (and elicit) negatively valenced affective states, they can also be interpreted positively in some contexts. Thus, inspired in recent developments in formal sociolinguistics, I propose an 'indexical' approach to affective meaning. Under this approach, an affective expression is associated with a set of affective qualities, anyone of which may emerge at a given context depending on the interpreter's prior assumptions about the speaker's affective states and/or relation with the target of the swear word. To define this set, also called 'indexical field', I will use the dimensions pleasure, arousal and dominance, standardly employed in cognitive psychology to characterize and measure affective episodes. In this dissertation, thus, the affective meaning of an expression is given by the set of affective states it typically conveys within a linguistic community, but its interpretation at a given context is established by taking into account the interpreter's prior assumptions about the speaker's affective states and/or attitudes with respect to the target of the affective expression. El objetivo de este artículo es realizar una historización del sistema sanitario de Neuquén, concretamente atendiendo a los programas de salud aplicados en esta provincia desde su surgimiento hasta el año 2020. En este marco, en primer lugar, me enfocaré en los lineamientos políticos que definieron las bases ideológicas de las políticas públicas llevadas a cabo en la atención sanitaria neuquina, y, en segundo lugar, examinaré las variables estadísticas publicadas por el sistema de salud provincial referidas a las condiciones materiales (...) de atención médica de la población en general, y de las mujeres indígenas mapuce en particular. The goal of this piece is to put some pressure on Brian O’Shaughnessy’s claim that perceptual experiences are necessarily mental processes. The author targets two motivations behind the development of that view. First, O’Shaughnessy resorts to pure conceptual analysis to argue that perceptual experiences are processes. The author argues that this line of reasoning is inconclusive. Secondly, he repeatedly invokes a thought experiment concerning the total freeze of a subject’s experiential life. I argue that rather than dismiss Foucault’s first book, Mental Illness and Personality, as an “apologetic exposition of Pavlov’s reflexology,” we ought see it as a valuable source documenting Foucault’s change of attitude towards psychology and the history of science in the early 1950s. I argue that there are two distinguishable strands that make up the text. The ‘frame’ of the book—the introduction, first chapter of the second part and conclusion of the book—is expressive of a critical attitude towards psychology, (...) and indicative of rather sophisticated conception of the history of science as a critical history aimed at bringing into view the unscientific forces that shape scientific labor. The ‘main body’ of the text—the first part and the second chapter of the second part—by contrast, reads as the history of the steady dialectical progress of the psychological sciences towards an ever more accurate understanding of mental illness. It is thus indicative to a naïve approach to psychology and to its history. The tension between the two strands of the book thus documents the starting point of Foucault’s then shifting attitudes toward the psychological sciences and the history of science, and the set of questions and sources that lead him to problematize his understanding of and approach to the latter. 1. The Bundle Theory I shall discuss is a theory about the nature of substances or concrete particulars, like apples, chairs, atoms, stars and people. The point of the Bundle Theory is to avoid undesirable entities like substrata that allegedly constitute particulars. The version of the Bundle Theory I shall discuss takes particulars to be entirely constituted by the universals they instantiate.' Thus particulars are said to be just bundles of universals. Together with the claim that it is necessary that (...) particulars have constituents, the fundamental claim of the Bundle Theory is: (BT) Necessarily, for every particular x and every entity y, y constitutes x if and only ify is a universal and x instantiates y. 2 The standard and supposedly devastating objection to the Bundle Theory is that it entails or is committed to a false version of the Principle of Identity of Indiscernibles (Armstrong 1978: 91, Loux 1998: 107), namely: (Pll) Necessarily, for all particulars x and y and every universal z, if z is instantiated by x if and only if z is instantiated byy, then x is numerically identical with y. The most famous counterexample to the Identity of Indiscernibles is that put forward by Max Black, consisting of a world where there are only two iron spheres two miles apart from each other, having the same diameter, temperature, colour, shape, size, etc (Black 1952: 156). Let us from now on think of the properties of the spheres in this world as universals. The possibility of this world, which I shall hereafter refer to as 'Black's world', makes (Pll) false.' Socrates’ burial is dismissed as philosophically irrelevant in Phaedo 115c-e although it had previously been discussed by Plato’s older contemporaries. In Antisthenes’ Kyrsas dialogue describes a visit to Socrates’ tomb by a lover of Socrates who receives protreptic advice in a dream sequence while sleeping over Socrates’ grave. The dialogue is a metaphysical explanation of how Socrates’ spiritual message was continued after death. Plato underplays this metaphorical imagery by lampooning Antisthenes philosophy and his work (Phd. 81b-82e) and subsequently precludes him (...) from an active role in the Phaedo. A similar case is the exclusion of Euclides of Megara. Fragments of a lost Socratic dialogue depict Apollodorus citing an unnamed Megarian in order to justify care for the remains of the dead. Similar mistaken notions explain Kyrsas’ belief when he lusts after Socrates even though he was dead. In spite of these disputes, the philosophers (Euclides, Antisthenes and Plato) each attempted to present Socrates’ moral influence as a force that continued after his death and burial. (shrink)

Si bien al hablar de igualdad y derechos colectivos nos situamos aparentemente en dos espectros distintos de los derechos humanos, siguiendo a VASAK y su teoría de las tres generaciones, de un lado en el rango de un derecho fundamental, y del otro, en toda una amplia gama de derechos de tercera generación, es en realidad, en una misma órbita en donde debemos ubicarnos: en la del Estado de Social Derecho. Y es allí, donde la capacidad que éste tenga para (...) hacer frente a los desafíos que trae consigo su cumplimiento -sin olvidar el de los derechos económicos, sociales y culturales-, se convierte en el mejor elemento de juicio para determinar su éxito o fracaso, en una sociedad fracturada por un sinnúmero de fenómenos que atentan cada vez más contra las garantías y libertades de los ciudadanos. En este contexto, en el marco del programa de actividades formativas del Doctorado en Estudios Interdisciplinares de Género y Políticas de Igualdad, se organizó un Foro Académico cuya pretensión no era otra sino la de presentar a la comunidad una serie de reflexiones sobre algunos de estos mencionados fenómenos, a partir de la visión aquí propuesta. The increasing application of artificial intelligence (AI) to healthcare raises both hope and ethical concerns. Some advanced machine learning methods provide accurate clinical predictions at the expense of a significant lack of explainability. Alex John London has defended that accuracy is a more important value than explainability in AI medicine. In this article, we locate the trade-off between accurate performance and explainable algorithms in the context of distributive justice. We acknowledge that accuracy is cardinal from outcome-oriented justice because it helps (...) to maximize patients’ benefits and optimizes limited resources. However, we claim that the opaqueness of the algorithmic black box and its absence of explainability threatens core commitments of procedural fairness such as accountability, avoidance of bias, and transparency. To illustrate this, we discuss liver transplantation as a case of critical medical resources in which the lack of explainability in AI-based allocation algorithms is procedurally unfair. Finally, we provide a number of ethical recommendations for when considering the use of unexplainable algorithms in the distribution of health-related resources. (shrink)

This work deals with the particular nature of consciousness in comparison to matter, as well as with the question of how conscious subjective experience can be possible at all. Based on a step-by-step derivation, a new approach is introduced and a theory for a possible explanation is proposed, named C-Pattern Theory. The statements and implications resulting from C-Pattern Theory reveal new perspectives on elementary aspects of reality and open up new possibilities with regard to fundamental questions.

In this note we shall argue that Milne’s new effort does not refute Truthmaker Maximalism. According to Truthmaker Maximalism, every truth has a truthmaker. Milne has attempted to refute it using the following self-referential sentence M: This sentence has no truthmaker. Essential to his refutation is that M is like the Gödel sentence and unlike the Liar, and one way in which Milne supports this assimilation is through the claim that his proof is essentially object-level and not semantic. In Section (...) 2, we shall argue that Milne is still begging the question against Truthmaker Maximalism. In Section 3, we shall argue that even assimilating M to the Liar does not force the truthmaker maximalist to maintain the ‘dull option’ that M does not express a proposition. There are other options open and, though they imply revising the logic in Milne’s reasoning, this is not one of the possible revisions he considers. In Section 4, we shall suggest that Milne’s proof requires an implicit appeal to semantic principles and notions. In Section 5, we shall point out that there are two important dissimilarities between M and the Gödel sentence. Section 6 is a brief summary and conclusion. (shrink)

¿Cómo es posible encontrar una constante en una obra que tiene en la ruptura su principal argumento? Una primera línea se puede percibir en el trabajo de Žižek sobre una política del goce cuya trayectoria circula desde el deseo a la pulsión. Desde una investigación muy orientada en el problema del sujeto, en el carácter sintomático del mismo, Žižek se ha desplazado hacia un análisis de la relación entre el objeto a y la pulsión en el marco del capitalismo actual. (...) En conexión con esta problemática se encuentra una segunda línea que tiene como punto central el trabajo crítico sobre las relaciones entre economía y política; frente al desafío que supone hoy en día la circulación espontánea del capital y el abandono del ámbito económico por parte de la teoría política. Por un lado nos encontramos con los dos sentidos del término escatología, el económico y el teológico-político, que convergen en la noción de exceso, sea de la pulsión o sea del objeto a. Al mismo tiempo, Žižek considera que no es posible traducir la atención sobre el exceso capitalista y su propia revolución inmanente en términos de dominación política.Ambas secuencias se encuentran, en definitiva, íntimamente vinculadas en la crítica de la economía política del discurso que Žižek lleva a cabo. La introducción del término paralaje puede servir como alternativa para entender la oscilación permanente que se produce en su obra entre síntoma y escatología. Una opción para leer a Žižek en función de sus incesantes desplazamientos, comenzando por el más fundamental: la paralaje entre lectura y escritura. (shrink)

O objetivo deste artigo é demonstrar como a ética proferida por Epicteto se relaciona com uma postura filosófica, mais precisamente com uma atitude filosófica. Essa atitude não é especificamente uma exigência prévia para pensar a ética filosoficamente, pois não se trata de tê-la para então começar a filosofar, mas trata-se da manifestação de autenticidade daquele que se diz filósofo, porque evidencia a real assimilação das opiniões e teorias que defende. Para Epicteto, o progresso do filósofo necessariamente está unido ao progresso (...) no campo ético, sendo impossível desvinculá-los. Por entender a filosofia como um modo de vida, ele adverte para que a teoria seja sempre colocada em prática, estabelecendo assim o conhecido caráter ascético de seus ensinamentos. (shrink)

El artículo analiza el papel del resentimiento en la Teoría de los sentimientos morales de Adam Smith y su conexión con el proceso de la simpatía mutua por medio del cual el “espectador imparcial” asume plenamente el resentimiento de la víctima, al considerar que su pasión se rige por los principios de la propiedad y la justicia. Se sostiene que el resentimiento no solo cumple un rol central en la teoría del castigo de Adam Smith, en la medida en que (...) permite retribuir, disuadir y rehabilitar al victimario sino que, además, aporta a la discusión contemporánea sobre el perdón y la reconciliación, pues convoca la posibilidad de superar el resentimiento y restablecer las relaciones sociales entre el agresor y la víctima. According to one of Leibniz's theories of contingency a proposition is contingent if and only if it cannot be proved in a finite number of steps. It has been argued that this faces the Problem of Lucky Proof , namely that we could begin by analysing the concept ‘Peter’ by saying that ‘Peter is a denier of Christ and …’, thereby having proved the proposition ‘Peter denies Christ’ in a finite number of steps. It also faces a more general but (...) related problem that we dub the Problem of Guaranteed Proof . We argue that Leibniz has an answer to these problems since for him one has not proved that ‘Peter denies Christ’ unless one has also proved that ‘Peter’ is a consistent concept, an impossible task since it requires the full decomposition of the infinite concept ‘Peter’. We defend this view from objections found in the literature and maintain that for Leibniz all truths about created individual beings are contingent. (shrink)

In der Kritik der Urteilskraft vertritt Kant noch die analogische Beziehung zwischen Schönheit und Sittlichkeit (KU, AA 05: 351–354). Aber wir befinden uns hier in einem ganz anderen Zusammenhang. Und dies nicht nur, weil die Erörterung dieser analogischen Beziehung eine Lösung für das Problem der Verknüpfung zwischen theoretischer und praktischer Vernunft beansprucht. Die Reflexionen in den Vorlesungen über Anthropologie über die pragmatische Dimension des Geschmacks setzten die Möglichkeit dieser Verknüpfung bereits voraus, bevor Kant eine kritische Begründung derselben erreichte. Wir dürfen (...) aber diese Reflexionen nicht als das Ergebnis unreifer Versuche zur Lösung dieses kritischen Problems der Rationalitätstheorie Kants deuten. Während der Paragraph 59 der Kritik der Urteilskraft Teil der spekulativen Philosophie ist, wird die Kritik des Geschmacks in den Vorlesungen über Anthropologie vielmehr insofern sinnvoll, da sie zu einem pragmatischen, populären und aufgeklärten Bildungsprogramm der Anthropologie Kants gehört. Aunque no es posible ofrecer aquí un análisis detallado de las diferentes cues tionesimplicadas en la teoría de las representaciones en la Modernidad, sí pode mos atender auno de sus aspectos más relevantes, presente en la exposición de Leibniz, Wolff,Baumgarten y Kant, a saber: el reconocimiento progresivo y la vin dicación de unconocimiento específicamente sensible como un tipo específico de conocimiento en lafilosofía escolar alemana del siglo XVIII. A pesar de que Leibniz atribuye al conocimiento claro y confuso el grado (...) más bajo en su esquema de los niveles del conocimiento, tambiénes cierto que su exposición apunta ya a la irre ductibilidad de este ámbito en unconocimiento finito como el humano. Por lo demás, lo confuso aquí adquiere sentido en elsistema del saber en la medida en que Leibniz considera que todos los conocimientos obre cuestiones de hecho, si bien falibles, se encuentran en conexión con la verdad en lamedida en que parti cipan de la misma, al expresar el fundamento último de lo real y sersusceptibles de perfectibilidad en el seno de una subjetividad dinámica que comienza aser entendida como unidad vital. En Wolff y Baumgarten se profundiza en la vía que esabierta ya por Leibniz: la exposición de los niveles de conocimiento en el marco de unaimbricación de la lógica de la representación con una psicología vitalista, en la que sereconocerá la experiencia del sentimiento como expresión subjetiva de la perfectibilidaddel conocimiento humano. Aunque la filosofía de Kant supondrá una ruptura con laexposición escolar de esta teoría de los niveles de conocimiento o los tipos derepresentación, lo cierto es que el nacimiento de su teoría de la sensi bilidad tiene lugar enel marco histórico de esta concepción tradicional. Since 1968, the irreversible loss of functioning of the whole brain, called brain death, is assimilated to individual’s death. The almost universal acceptance of this neurological criterion of death had decisive consequences for the contemporary medicine, such as the withdrawal of mechanical ventilation in these patients and organ retrieval for transplantation. The new criterion was successfully accepted in part because the assimilation of brain death state to death was presented by medicine --and acritically assumed by most of societies-- as a (...) scientific and objective fact. Nevertheless, many people do not think that the patients suffering brain death are actually dead. We show here that those people are not necessarily wrong. It can be argued that, in fact, the justification of the neurological criterion is not scientific but moral. We outline the thesis that the problem surrounding the vital status of brain dead patients is due to a confusion between factual and normative questions. Furthermore, we claim that the donation of organs and the withdrawal of life-support could be ethically acceptable even if the patients suffering brain death are considered as alive. As an alternative to the dead donor rule, we propose a justification for organ donation of brain-dead patients based on the (moral) concepts of harm and consent : what truly justifies the procurement of organs on those patients is not that they are dead, but that they wish to donate their organs and that, since they have irreversibly lost their brain, they cannot be harmed. It argues, against what some have maintained, that remark 202 is not meant to reject the possibility of a private language as this is defined in remark 243.

En este capítulo se estudia la facultad a prevención contenida en la Ley 1333 de 2009, para analizar la forma en la que el derecho ambiental ha venido construyendo una dogmática y reglas propias, escapando de la tradición del derecho administrativo, así como creando la dogmática propia necesaria para lograr su independencia y consolidación como un área autónoma de la disciplina jurídica. Al respecto, en este ejercicio de reflexión es posible ver cómo la figura aparte de estar diseñada por fuera (...) de la teoría general del acto administrativo, también posee particularidades que la hacen única dentro del ordenamiento jurídico colombiano. Anger is often an appropriate reaction to harms and injustices, but is it a politically beneficial one? Martha Nussbaum (Journal of the American Philosophical Association 1 (1), 41–56, 2015, Anger and Forgiveness. Oxford University Press, 2016) has argued that, although anger is useful in initially recruiting agents for action, anger is typically counterproductive to securing the political aims of those harmed. After the initial shockwave of outrage, Nussbaum argues that to be effective at enacting positive social change, groups and individuals (...) alike, must move quickly out of the state of anger. Feminist theorists (Frye, The Politics of Reality. Crossing Press, 1983; Lorde, 1997; Narayan, Hypatia 3 (2): 31–48, 1988) on the other hand have for long highlighted the efficacy of anger, as well as its moral and epistemic value, in fighting against the oppressive status quo. It might be thought therefore that for political action to be effective, a continued state of anger is preferable. Protestors must after all create and sustain a sense of moral obligation and justice. A main way of doing so is to promote successive moral shocks that trigger outrage (Jasper, Emotion Review 6 (3): 208–213, 2014). I present a novel, empirically informed defense of anger’s efficacy in political action. Nussbaum holds a traditional view on the nature of anger, inherited from Aristotle and the Stoics, which holds that anger constitutively involves a desire for retribution. The view that anger is counterproductive falls out of this and is dominant in academic work as well as in our personal and political lives. Based on work in social psychology, I argue that we need to reconsider this. In doing so, I highlight anger’s aim for recognition, rather than retribution, as key. Furthermore, I uncover conditions for anger’s political efficacy, as well as reasons for why the traditional view of anger has been so pervasive. (shrink)

In the following paper I will examine the possibility for a rational foundation of morals, rational in the sense that to ground a moral statement on reason amounts to being able to convince an unmotivated agent to conform to a moral rule - that is to say, to “rationally motivate” him (as Habermas would have said) to act in ways for which he or she had no previous reason to act. We will scrutinize the “internalist’s” objection (in Williams’ definition) to (...) such a claim and confront it with a, however, obvious fact: our need to convince or, at least, to influence agents to act according to moral judgements that entail strong validity claims. Therefore we need to find a better ground for our moral norms than that provided by a narrow concept of practical reason, which ultimately offers the basis for the internalist’s intuitions. Classical philosophers believed that to have a “right” sense meant also to think accordingly, that there was no intelligence without a social or moral side and that a person who lacked moral sense was not, at the same time, very intelligent. This contradicts some deep Humean intuitions, and in any case requires a more complex concept of practical reason than the one we normally encounter in internalist moral philosophers. In the following pages, I would like to reflect on this kind of social reason, or intelligence, or moral rationality, in an attempt to couple, in a coherent vision of moral sense within the framework of practical reason, intuitions that appear in Kant and Adam Smith with empirical research about what the lack of moral sense could mean. Or are individual-level analyses more appropriate for assessing the influence of values on ethical behaviors across country workforces? Using multi-level analyses for a 48-society sample, we test the utility of both the societal-level and individual-level dimensions of collectivism and individualism values for predicting ethical behaviors of business professionals. Our values-based behavioral analysis indicates that values at the individual-level make a more significant contribution to (...) explaining variance in ethical behaviors than do values at the societal-level. Implicitly, our findings question the soundness of using societal-level values measures. Implications for international business research are discussed. (shrink)

Alireza Bagheri supports a policy on organ procurement where individuals could choose their own definition of death between two or more socially accepted alternatives. First, we claim that such a policy, without any criterion to distinguish accepted from acceptable definitions, easily leads to the slippery slope that Bagheri tries to avoid. Second, we suggest that a public discussion about the circumstances under which the dead donor rule could be violated is more productive of social trust than constantly moving the line (...) between life and death. La Inteligencia Artificial (IA) ha supuesto un gran avance para la humanidad en diversos campos; sin embargo, eso no implica que su actividad esté exenta de reflexión ética. La humanidad está enfrentado, y va a enfrentar en el futuro, numerosos desafíos que van a obligar a elaborar nuevas ideas para poder vivir a la altura de los tiempos. Entre esos desafíos encontramos el laboral y económico, el de mejoramiento humano, el militar y de seguridad y el político y jurídico, entre (...) otros. Así pues, una vez considerados los desafíos en el terreno de la IA, una referencia ética que puede servir para enfrentar dichos desafíos, puede ser el principio de responsabilidad de Hans Jonas. La lectura de este aporte ético puede facilitarnos unas primeras coordenadas para la orientación en medio de un horizonte de posibilidades nuevo para la humanidad y, adicionalmente, servir como punto de partida en el compromiso que deben asumir los diferentes saberes implicados en este novedoso campo. The Razor says: do not multiply entities without necessity! The Laser says: do not multiply fundamental entities without necessity! Behind the Laser lies a deep insight. This is a distinction between the costs and the commitments of a theory. According to the Razor, every commitment is a cost. Not so according to the Laser. According to the Laser, derivative entities are an ontological free lunch: that is, they are a commitment without a cost. Jonathan Schaffer (2015) has argued that the (...) Laser should replace the Razor. In Sections 2-4 we shall discuss and argue against Schaffer’s arguments for replacing the Razor with the Laser. Schaffer considers several objections to his views, and in Sections 5-7 we shall argue that Schaffer does not deal successfully with two of them. In Section 8 we shall present a probabilistic argument for the Laser. However, the argument has a limitation and does not support the replacement of the Razor with the Laser. Indeed, it supports only the claim that, given certain assumptions, the multiplication of explanatorily relevant derivative entities does not matter; but, as we argue in the same section, there is an argument that multiplying explanatorily superfluous derivative entities does makes a theory less rationally acceptable. Our conclusion is that the Laser cannot replace the Razor and that derivative entities are not an ontological free lunch. (shrink)

Este artículo trata de una inscripción constructiva omeya andalusí del año 387 / 4 enero 997-2 enero 998, hoy perdida, pero transmitida a través de un resumen castellano incluido en una lápida de 1259 "reparada" en 1575. Se intenta la restitución del texto árabe original y se estudian los hechos y los personajes documentados.

En el presente trabajo reflexionamos en torno a una serie de textos en los que Michel Foucault se pregunta por estatuto de la crítica. La cuestión nos parece volverse reflexivamente sobre el propio Foucualt y por ello intentaremos evaluar de qué manera, con sus propios recursos conceptuales, se puede determinar el estatuto de su propio discurso. Para ello recorreremos dos caminos: (i) su rechazo de la noción de ideología que lo pone en tensión con algunas de las tradiciones mayores del (...) pensamiento crítico. La cuestión es aquí: ¿cómo es posible la crítica sin la ideología y sin la verdad?; (ii) la recuperación foucaultiana de la actitud crítica (en los textos sobre Kant y la pregunta Was ist Aufklärung?). A partir de allí Foucault recupera la problemática de la modernidad en términos de una “ontología histórica del presente”. Ambos caminos se cruzan, ya que las observaciones sobre una “política de la verdad” (lo otro de la crítica de la ideología comprometida con una verdad aséptica) se refuerzan con las de la cuestión del gobierno en términos de una “inservidumbre voluntaria”. En ambos casos, la práctica de la crítica, que subjetiviza desujetando, plantea la cuestión de la libertad. -/- We analyze Michel Foucault’s question for the status of critique and its reflexive return over Foucault himself: How Foucault’s discourse, qua critique, should be understood? We will drive two paths: (i) the refusal of the notion of ideology, where the question is: How to think of critique without ideology and truth?; (ii) the Foucauldian recovery of the “critical attitude” (in the texts on Kant’s answer to the question Was ist Aufklärung?) and of the problem of modernity, along the lines of a “historical ontology of the present”. There is a crossroad of (i) and (ii), since the remarks on a “politics of truth” (as opposite to an “ideology critique” committed with an aseptic truth) reinforces mutually with the problem of the government, faced along the lines of an art of the “voluntary inservitude”. In both cases, practice of criticism that subjectifies desubjugating, poses the question of liberty. (shrink)

Las organizaciones públicas se comunican con los ciudadanos de diversas formas, y no están ajenas a la utilización de las redes sociales. La investigación tiene como finalidad analizar la comunicación de la Responsabilidad Social de las empresas públicas uruguayas, a través de la red Twitter. Para el análisis de los tweets se emplea la herramienta Burrrd, Twelets y se utiliza, como referencia, la metodología propuesta por Aldeanueva y Arrabal (2018), identificando un diccionario de términos relacionados con responsabilidad social en las (...) publicaciones realizadas, agrupándolos por temáticas comunes, a fin de analizar qué comunican las organizaciones públicas sobre su responsabilidad social. En este artículo presentamos las principales corrientes de la Filosofía Experimental y atendemos a una de las críticas más severas a la que se ha sometido este reciente programa de renovación metodológica. Según Antti Kauppinen la Filosofía Experimental está condenada al fracaso porque no puede obtener mediante sus métodos el tipo de intuiciones que interesan a los filósofos –las intuiciones robustas del hablante competente. Aun aceptando parte de las críticas de Kauppinen, en este artículo sostenemos, en primer lugar, que la (...) supuesta incapacidad de la Filosofía Experimental para acceder a las intuiciones robustas de los hablantes tiene que ver en gran medida con los métodos experimentales empleados hasta ahora por los filósofos experimentales. En segundo lugar, defendemos que el proyecto de reforma llevado a cabo desde la Filosofía Experimental resultará viable solo si se adoptan una serie de consejos metodológicos procedentes de la economía experimental. Únicamente entonces podrán los experimentalistas responder con éxito a la objeción de Kauppinen. (shrink)

In this paper we present a new framework of idealization in biology. We characterize idealizations as a network of counterfactual and hypothetical conditionals that can exhibit different “degrees of contingency”. We use this idea to say that, in departing more or less from the actual world, idealizations can serve numerous epistemic, methodological or heuristic purposes within scientific research. We defend that, in part, this structure explains why idealizations, despite being deformations of reality, are so successful in scientific practice. Background: Several countries have recently changed their model of consent for organ donation from opt-in to opt-out. We undertook a systematic review to determine public knowledge and attitudes towards these models in Europe. Methods: Six databases were explored between 1 January 2008 and 15 December 2017. We selected empirical studies addressing either knowledge or attitudes towards the systems of consent for deceased organ donation by lay people in Europe, including students. Study selection, data extraction, and quality assessment were conducted by (...) two or more reviewers independently. Findings: Awareness of the consent model was lower in opt-out countries than in opt-in countries. A majority of the public agrees with opt-in, regardless of the law in their own country. There are ambivalent attitudes regarding the opt-out system. The public tend to prefer opt-in and mandatory choice over opt-out when several options are offered. Interpretation: The assumption that people in opt-out countries are aware of the legal requirements to be excluded from the pool of potential donors is not supported by the results of this review. This is a concern, since ignorance hinders people's autonomy regarding organ donation decision-making. Higher awareness of consent model in opt-in countries may reflect greater efforts to inform the public through campaigns to motivate donation. Legal moves towards opt-out are at odds with people's expressed preferences. Main limitations of this review are the lack of data from some countries, study population heterogeneity, and methodological shortcomings. (shrink)

Self-control is deemed crucial for reasons-responsive agency and a key contributor to long-term wellbeing. But recent studies suggest that effortfully resisting one’s temptations does not contribute to long-term goal attainment, and can even be harmful. So how does self-control improve our lives? Finding an answer requires revising the role that overcoming temptation plays in self-control. This paper distinguishes two forms of self-control problems: temptation (the presence of a strong wayward motivation) and apathy (the lack of commitment-advancing motivation). This distinction makes (...) it possible to separate negative self-control (aimed at overcoming temptation) from positive self-control (aimed at overcoming lack of motivation). The paper argues that temptation should not play a central role in our conception of self-control, since overcoming temptation is neither necessary nor sufficient for successful self-control. (shrink)
